Western Cape High Court hears challenge to the Expropriation Act's constitutionality

DA supporters at the Western Cape High Court where the Expropriation Act is being challenged.

An application challenging the constitutionality of the Expropriation Act was brought before the Western Cape High Court on Monday.

The DA has joined AfriForum and The Institute of Race Relations (IRR) as applicants in the matter which has been set down for five days.

The DA argues that the Act is unconstitutional in that it undermines property rights by allowing “nil compensation”, known as expropriation without compensation.

DA leader, Geordin Hill-Lewis, said the party argued that the bill was unlawfully adopted by the National Council of Provinces (NCOP) due to it lacking the required votes from at least five provinces.
