NFP heads to court to force Speaker to implement recall of MPL Mbali Shinga

NFP Secretary-General Sunset Bheki Xaba says the party’s court action over Cynthia Mbali Shinga’s recall is about constitutional limits and the powers of political parties.

The National Freedom Party (NFP) has approached the KwaZulu-Natal High Court in Pietermaritzburg in a bid to compel the provincial legislature's Speaker, Nontembeko Boyce, to implement its decision to recall its deployed MPL, Mbali Shinga.

The party said the matter had been enrolled for hearing on 30 July 2026, with the NFP seeking declaratory and mandatory relief over what it described as the Speaker’s continued refusal to implement its recall decision.

NFP secretary-general Sunset Xaba said the legal challenge was not about defying a court order, but about the constitutional limits of public power and the authority of political parties to manage their internal affairs.

"The NFP has consistently maintained that this matter has never been about defying a court order.
