KZN Legislature speaker Nontembeko Boyce has been dragged to court over her refusal to remove Mbali Shinga from the Legislature.
The National Freedom Party (NFP) has dragged the KwaZulu-Natal Legislature Speaker Nontembeko Boyce to court over her refusal to remove their expelled party member, Mbali Shinga.
The party filed court papers on Thursday and the matter has been set down for Thursday, July 30. In a statement by the party's Secretary-General Sunset Xaba, it said it had taken the decision to approach the court to seek 'appropriate declaratory and mandatory relief arising from the continued refusal by the Speaker to implement the party's lawful decision to recall its deployed member'.
Xaba said the decision follows careful legal consideration and is consistent with the party's unwavering commitment to the constitution of the country, the rule of law, the rules of the provincial Legislature and the party’s constitution which collectively govern the deployment and recall of public representatives.
“Political parties derive their constitutional autonomy from Section 19 of the constitution. The deployment, discipline and recall of public representatives remain internal organisational functions unless set aside by a competent court. The party therefore looks forward to the hearing on 30 July 2026, where it will respectfully request the court to affirm the constitutional autonomy of political parties, uphold the rule of law, and direct that the lawful decision of the party be implemented without further delay,” reads the statement.
