Acourt in the Marche city of Pesaro has approved the adoption by a gay man of a minor who is the biological child of his male partner and was born via surrogacy in the United States, local newspaper Corriere Adriatico reported on Thursday.
The adoption was approved even though surrogacy is illegal in Italy and legislation passed in 2023 made it a 'universal crime', meaning Italians can be punished for it, even if the procedure is done in countries where it is legal.
"The minor must be protected regardless of the manner in which it came into the world," the judges wrote in the ruling, according to the report.
The child was born before the law making surrogacy a universal crime was passed.
The couple also have another child, whose adoption by the non-biological father was approved in October 2023.
