A Western Cape High Court judge has struck an urgent application off the roll by the Richard Harris Family Trust to evict 26 Constantia occupants, saying the trustees had not shown why a final eviction order could not be heard in the ordinary course.

In July, the matter attracted public attention after political parties and human rights activists supported the occupants, who comprise of two families. They are represented by their main member, Subeiga Matthews also known as Benjamin.

The families claim they have generational ties to the property known as 2133 Pagasvlei Farm in Constantia dating back to the 1800s and that their ancestors were buried at Spaanschemat Cemetery.

Matthews and family members were evicted by the owners, who requested that police remove them from the property in July.
