MANILA, Philippines — The prosecution and the defense panels in Vice President Sara Duterte’s impeachment trial will assess whether or not to to replace their respective spokespersons following Senate impeachment court presiding officer Francis Escudero’s recent decision on the sub judice rule.
Escudero on Wednesday made it clear that under Rule 18 of the Rules of Procedure, senator-judges, prosecutors, as well as the impeached official and their counsel shall refrain from making any public comments “pertaining to the merits of a pending impeachment trial.”

Lawyers from the prosecution and defense who violate the rule face public reprimand with admonition on their first strike, while a monetary fine of P30,000 with the possibility of being restricted from speaking, objecting, or examining witnesses on the floor may be imposed upon them on their subsequent violations.
