THERE is no longer any need for the constitutional claims brought by businessman Dominic Hadeed, his wife Genevieve and her aunt, Star Sabga, challenging their detention under preventive detention orders (PDOs) to be heard on an expedited basis now that all three have been released from prison.The position was agreed by attorneys representing the claimants and the State when the matters came before Justice Vigel Paul yesterday.Senior Counsel Rishi Dass, appearing for the claimants, told the judge the urgency which had prompted applications for expedited hearings had now been “lessened” following Sabga’s release from prison on Monday night.Dass said both sides had agreed that the claims, which all arise from the same alleged assassination plot and raised substantially similar legal issues, should now proceed together.Justice Paul accepted the proposal and approved a timetable for the filing of amended pleadings and additional evidence ahead of the substantive hearing.The judge ordered that the claimants file and serve amended fixed-date claim forms, together with supplemental affidavits, on or before August 26.Attorneys representing the State, Gerald Ramdeen and Dayadai Harripaul, have until September 28 to file affidavits in opposition, while any replies by the claimants must be filed by October 12. The substantive hearing will take place on October 19 at 2 p.m.While he said he had no issue with attorneys for the claimants amending the claims, Ramdeen submitted that those amendments should be limited to events that have occurred since Justice Paul granted Sabga interim relief and ordered her release from prison on Monday.The constitutional proceedings stem from the detention of the Hadeeds and Sabga under PDOs issued during the ongoing state of emergency (SoE).Dominic and Genevieve Hadeed were detained on June 24 after the State alleged they were involved in a conspiracy to assassinate Prime Minister Kamla Persad-Bissessar and other senior Government officials.Their detention came to an end on July 23 after Homeland Security Minister Roger Alexander revoked the PDOs issued against them.The couple were released from prison and are not subject to any court-imposed restrictions.Sabga was detained on June 25, under a separate PDO after the State alleged that a leaked audio recording of a June 11 conversation between her and Genevieve Hadeed implicated her in the same alleged conspiracy.On Monday, Justice Paul ordered Sabga’s release after finding that she had raised a serious issue to be tried, and that the balance of convenience favoured granting her interim constitutional relief pending the hearing of her claim.She remains under strict house arrest at her Regents Park, Westmoorings, home, where she is under police supervision.She has surrendered her passport and electronic devices, cannot leave the residence except for medical emergencies, and is prohibited from communicating with people outside the home except for legal, medical and approved family visits.
