The EFF argued that the majority judgment of the Western Cape High Court, which ruled in favour of President Cyril Ramaphosa to interdict the Impeachment Committee, is fundamentally flawed and ought to be overturned.
This comes as the EFF has joined the African Transformation Movement (ATM) in seeking leave to appeal Friday’s majority ruling.
They said that their application is based on the fact that they seek the same relief as ATM and are united in opposition to Ramaphosa’s attempt to prevent Parliament from carrying out its constitutional responsibility to hold him accountable.
Judges Diane Davis and Andre le Grange agreed with Ramaphosa, while Judge Matthew Francis delivered a dissenting view.
