Following a recent Western Cape High Court ruling, it was determined that magistrates lack the jurisdiction to issue arrest warrants for immigration detention, as these powers belong solely to immigration officers. This ruling created a legal obstacle for Home Affairs' application, and the matter has been stood down to allow the legal parties time to find a resolution and determine a way forward.
The Department of Home Affairs is seeking confirmation of Adetshina’s detention for deportation.
The department insists that she is not lawfully in South Africa and wants legal authority to detain her while deportation proceedings continue.
