The City of Johannesburg requests a deadline extension for Nersa's tariff review, fearing consumers would want refunds.
The City of Johannesburg will urgently turn to court this week to extend a deadline set by Judge Anthony Millar earlier this year for the National Energy Regulator of South Africa (Nersa) to redetermine electricity tariffs for 2024/25.
In January, Judge Millar, sitting in the Gauteng High Court, Pretoria, had set aside Nersa’s tariff determinations for the Cities of Johannesburg, Ekurhuleni, Madibeng, and Msunduzi. The court found these determinations unlawful due to the absence of necessary Cost-of-Supply (CoS) studies.
The judgment ordered Nersa to restart the determination process for these municipalities by June 30. The court stipulated that should the energy regulator fail to meet this deadline, the municipalities must revert to tariffs from previous financial years. Nersa, meanwhile, failed to redetermine the tariffs by the end of June.
The City of Johannesburg (CoJ) now wants the June 30 deadline to be extended to September 30. The City of Ekurhuleni earlier managed to obtain an extension through a court order.
