The Department of Justice (DOJ) said Tuesday it would refer to the National Bureau of Investigation (NBI) the probe and appropriate action regarding the spread of false information on the case of embattled Senator Ronald "Bato" dela Rosa. The DOJ confirmed that it has received the referral from the Presidential Communications Office (PCO) for the possible filing of charges against four Facebook accounts that allegedly claimed the Supreme Court had blocked the arrest of Dela Rosa. "The DOJ confirms that it received on June 1, 2026 the referral from the PCO regarding alleged social media posts spreading misinformation concerning the Supreme Court's ruling involving Sen. Dela Rosa," the DOJ said in a statement."The matter will be referred to the NBI for investigation and appropriate action, including possible case build-up for the filing of criminal charges, if warranted," it added. The PCO said Monday the accounts published similar posts falsely claiming that the High Court had "officially stopped" any attempt to arrest or surrender Dela Rosa to the International Criminal Court (ICC) or any foreign authority. The posts were also presented as news, using phrases such as "JUST IN," "Breaking News," "landmark ruling," and "The Court clearly stated…"PCO Director Robertzon Ramirez made the endorsement for DOJ evaluation for possible violations of Article 154 of the Revised Penal Code, as amended by Republic Act 10951, in relation to the Cybercrime Prevention Act of 2012.It can be recalled that the Supreme Court earlier denied Dela Rosa's request for a temporary restraining order (TRO) and/or status quo ante order (SQAO) in connection with his possible arrest under the ICC warrant. The Supreme Court later clarified, however, that it has yet to rule on the main petition filed by Dela Rosa and former President Rodrigo Duterte on whether or not a warrant issued by the International Criminal Court can be served through Philippine authorities even though the country is no longer part of the Rome Statute. — VDV, GMA News
