The understanding that the fertilised egg, embryo or foetus is not yet a person is expressed in some, but not all, components of Kenyan law.
Commonly referred to as foetal personhood, this legal concept considers human foetuses as entities that have rights and obligations in a legal system.
This assignment of rights then guarantees a foetus a level of protection, often prioritised over born people.
