The Supreme Court of Appeal has dismissed an appeal by Equal Education and the South African Democratic Teachers’ Union.
The Supreme Court of Appeal has dismissed challenges by Equal Education and South African Democratic Teachers’ Union (Sadtu) over laws providing for collaboration schools, donor-funded public schools and a provincial school evaluation authority.
The appeal was against the order and judgment issued by the Western Cape High Court.
Equal Education had argued that the Western Cape Provincial School Education Amendment Act failed to guarantee learners and parents representation on school governing bodies.
They also argued that the amendment Act failed to provide adequate criteria for conversion of a public school to either a collaboration school or donor-funded school.
