Justice and Constitutional Development Minister Mmamoloko Kubayi said a substantial number of dockets screened by prosecutors were found to be lacking a reasonable prospect of success primarily due to lack of evidence.
Justice and Constitutional Development Minister Mmamoloko Kubayi said her department does not have the details for the withdrawal of firearm cases because the reasons were not available.
Responding to DA MP Nicholas Gotsell during a question-and-answer session in the National Council of Provinces, Kubayi said the reasons for the withdrawal of each specific case were recorded on the individual case docket, which were returned to the SAPS.
“The National Prosecuting Authority (NPA) does not maintain a record of the reasons for the withdrawal,” she said.
Kubayi was asked about the impact of the development of an Electronic Case Management System amid the significant number of firearm-related cases that are withdrawn or did not result in convictions, particularly in gang-affected areas such as the Cape Flats.
