Daniel Kinahan (49) has appeared before the Special Criminal Court in Dublin where he faced a charge of directing organised crime. He was brought before a special sitting at the Courts of Criminal Justice (CCJ) on Sunday evening.Kinahan appeared before Judges Patrick McGrath, Fiona Lydon and Sarah Berkeley at the juryless court. He was wearing a black hoody top and tracksuit bottoms to match. He was carrying a bottle of water and also had a greying beard and wore black glasses.Det Sgt Colin Davidson of the Garda’s Drugs and Organised Crime Bureau told the court he handed Kinahan a copy of the charge sheet in the court building and explained it to him in clear language.Davidson told the court he arrested Kinahan at 6.49pm on Sunday in Casement Aerodrome and explained the charge to him. Kinahan replied he understood what had been said.Judge McGrath addressed Kinahan, who immediately stood up, asking him if it was correct he was not legally represented at the hearing.“Yes, that’s correct your honour, I didn’t have time to arrange anything,” he said, explaining he had been in isolation since last Friday, on remand in a Dubai prison, ahead of his extradition on Sunday.“I assumed a family member would have contacted some legal representation,” he added, before retaking his seat in the dock.When the judge gave him the option of appearing in court at his next scheduled appearance in two months by video link, rather than in person, Kinahan replied: “Do I have to decide now, your honour?”It was also explained to him that if he was to apply for bail, that application would have to be made to the High Court.“I understand, I think we know I won’t be getting bail, but thank you for explaining that judge,” he told McGrathHe also said: “I understand everything, thank you your honour”, when he was told he would appear again in court on October 5th and would have time to put in place a legal team before that date.Kinahan also spoke to confirm his name, stating “yes I am” when asked if he was Daniel Kinahan just before the charge was read out to him.He faces a single charged of “directing the activities of a criminal organisation” between October 18th, 2015, and April 6th, 2017. The alleged offence is contrary to section 71A of the Criminal Justice Act 2006, as amended by the Criminal Justice (Amendment) Act, 2009, and as applied by section 74 of the Criminal Justice Act 2006, as amended by the Criminal Justice (Amendment) Act 2009.When the 15-minute court hearing concluding just before 8.25pm, Kinahan was led away by gardaí in the court. He was then taken by gardaí, traveling in a convoy of vehicles, to Portlaoise Prison, where he will remain on remand pending his trial, unless granted bail.The married father of five earlier on Sunday became the first Irish person ever extradited from United Arab Emirates (UAE) under a new, permanent extradition treaty, which came into force last year. He was brought back to Ireland on the Government jet, flown by Air Corps personnel and with a team of gardaí on board, after a first extradition treaty was agreed between Ireland and UAE.Kinahan was arrested in Dubai in April on foot of an extradition request from the Irish authorities after the DPP directed he face a charge of directing organised crime. He had been in custody in Dubai since then as his extradition case went through the courts, concluding late last month. On Sunday, an Air Corps flight carrying Kinahan, who has lived openly in Dubai with his family for a decade, touched down shortly after 6.30pm at Casement Aerodrome, Baldonnel, Co Dublin.Daniel Kinahan Kinahan was arrested on the tarmac for the purposes of charging. He was then taken across the city to the courthouse in Dublin’s north inner city in a Garda convoy. The Garda helicopter circled above as part of the security operation, with some rolling road closures also in place.A small crowd gathered at Baldonnel to see him being taken from the Defence Forces airport by gardaí. Another crowd was present around the CCJ, having gathered there to get a glimpse of him.His appearance at the CCJ on Sunday night was the only activity in the vast complex, with Kinahan’s hearing drawing a very large group of journalists and gardaí, many of whom are attached to the Garda’s Drugs and Organised Crime Bureau (DocB), which has investigated Kinahan.Some members of the public were also granted access to the court after queuing with members of the media, presenting identification, being searched and leaving their phones with Garda members outside.More to follow
