Knysna residents fight back against unlawful evictions.
Knysna municipality sought to demolish about 90 occupied homes in Sedgefield without an eviction order, the Western Cape High Court has found.
Judge Deidre Kusevitsky ruled that the municipality had deliberately sought to circumvent the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act, known as PIE.
She said its conduct showed a disregard for the rights of people living on the land.
"That they persisted with such gusto and disregard for the constitutional and human rights of the occupiers indicated a glaring lack of appreciation of the legislation and the constitution.
