The Gauteng High Court orders the Ekurhuleni Municipality to rebuild the homes of several of the residents of the Albert Luthuli informal settlement which were demolished last month.
The Gauteng High Court, Johannesburg, has ordered the City of Ekurhuleni to rebuild demolished homes at the Chief Albert Luthuli informal settlement near Benoni by Wednesday, June 17, and slammed the municipality for acting with callous disregard for residents’ dignity.
Judge Stuart Wilson on Friday issued an urgent interim order restoring about 570 families to the settlement, also known as the N12 settlement.
On Sunday, he gave reasons for his judgment, saying the municipality acted contrary to the Constitution and in apparently callous disregard of the occupiers’ rights to dignity when it caused hundreds of structures to be demolished last month.
The Friday's interim relief allowed the displaced individuals and families to return to the property near Cloverdene in Benoni.
