MANILA, Philippines — The Supreme Court (SC) has affirmed the ruling of the 2021 Malabon City Regional Trial Court that declared the tracking of commercial fishing boats “unconstitutional.”
In a decision promulgated on January 21 and penned by Associate Justice Maria Filomena Singh, the SC affirmed that Fisheries Administrative Order (FAO) No. 266, signed by the Department of Agriculture (DA) in 2020, was null and void.
FAO 266 is a regulatory measure that implements the Vessel Monitoring System (VMS) and installs the Electronic Reporting System (ERS) in commercial fishing vessels operating in the country to detect illegal, unreported, and unregulated (IUU) fishing.
