A Supreme Court of Appeal judgement on 30 April 2026 directed the Road Accident Fund (RAF) to revert to the 2008 RAF 1 Form. This notice outlines the ruling and subsequent claims process.1: Acceptance of ClaimsWith immediate effect:Previously rejected claims that met the minimum legal requirements in terms of Section 24 of the RAF Act will be accepted for re-processing, using the 2008 RAF 1 Form.This only applies to claims lodged from 6 May 2022 onwards.Claims previously submitted and accepted using the 2022 RAF 1 Form do not have to be resubmitted.Completed forms must be submitted with the required information and supporting documents. 2: Prescription (Time Limits for Claims)Claims previously rejected due to the relevant Board Notice will not prescribe up to and including 30 September 2026.These claims will retain their original submission date.New claims that were never submitted before do not qualify for this waiver. If they have already prescribed, they will remain invalid.3: Submission Date GuidelinesTo determine the official date of submission.Postal submissions: The date of the Post Office stamp will apply.Hand-delivered submissions: The date reflected on the RAF office stamp, claim system record, or original submission date will be used.4: Support and AssistanceRegistration and processing of these claims is a priority for the RAF.Due to the influx of re-lodgments, the public is requested to allow sufficient time for the RAF to attend to these claims.
