The Public Protector has identified five major service delivery failures by the City of Cape Town, finding that residents of Langa Flats and Khayelitsha were denied constitutionally required municipal services and ordering binding remedial action

Public Protector Kholeka Gcaleka has found that the City of Cape Town Metropolitan Municipality failed to provide basic municipal services to residents of Langa Flats, and Khayelitsha Township in a progressive and effective manner as required by the Constitution.

Releasing the report following a systemic investigation, Gcaleka said the investigation found that complaints of poor service delivery were substantiated, with the municipality’s conduct amounting to improper conduct, maladministration and prejudice against affected residents.

“The provision of basic municipal services is not merely an administrative function; it is also a fundamental constitutional obligation that directly impacts the human dignity, safety and well-being of the People of South Africa,” Gcaleka said.

The investigation originated from complaints raised by residents during the Public Protector South Africa’s annual roadshows in the Western Cape in March 2022 and April 2023.
