Court overturns conviction of man in R2.9 million theft case, highlighting State errors.
The Mpumalanga High Court has overturned the conviction and prison sentence of a man accused of involvement in the misappropriation of R2.95 million earmarked for community development in Mpumalanga, finding that crucial banking evidence used to secure his conviction was inadmissible.
The high court upheld an appeal by Jacob Zenezele Mncwango, who had been convicted by the Mbombela Regional Court in January 2023 on charges of theft and money laundering arising from the disappearance of funds intended for the Endloveni Community.
Mncwango had originally been charged alongside two co-accused with fraud, alternatively theft, and two counts of money laundering. The Regional Court convicted him on the alternative charge of theft and one count of money laundering. He received an effective sentence of seven years' imprisonment after being sentenced to ten years for theft, with three years suspended, and a further three years for money laundering to run concurrently.
The prosecution alleged that during 2012, the accused falsely represented to the Department of Rural Development and Land Affairs that services had been rendered to the Endloveni Community through a community development project. Authorities claimed that documents, including resolutions, memoranda and invoices, were submitted to support payments that were never legitimately earned.
