Kenyan High Court has temporarily halted plans for the United States to establish an Ebola quarantine facility in Kenya.

Late on Thursday, High Court Judge Patricia Nyaundi ordered that, pending the outcome of a legal challenge, Kenya must not admit anyone exposed to or infected with Ebola under the proposed agreement with the U.S.

The injunction follows a White House announcement earlier that day saying the U.S. intended to set up a facility in Kenya to quarantine American citizens who had been exposed to Ebola, and that it would not repatriate them if they developed symptoms, preferring instead to transfer such cases to a third country.

The rights group Katiba Institute filed the suit on Thursday, criticizing the proposal as “secretive” and “unilateral” and arguing it raised serious constitutional issues.

The organisation said the plan threatened rights to life and health, and bypassed requirements for fair administrative action, public participation, and parliamentary oversight.
