THE case in which Com­missioner of Police Allister Guevarro had charged two men with keeping a brothel (prior to his appointment as the country’s top cop) came up for hearing yesterday, with the court setting a date to rule on the defence’s submission that the prosecution failed to pre­sent enough evi­dence to lead to convictions.The State yesterday sought to reopen its case against Sheldon Lewis and Vaughn Eversley, but defence attorney Keith Beckles called for the 13-year-old matters to be dismissed.Senior Magis­trate Armina Deo­na­­rine­singh was ex­pected to rule on the no case submission made in the past by Beckles, but she no­ted receipt of the State’s application to reopen its case.This application stemmed from a pocket diary from Guevarro which the prosecution is claiming contains information for its case following Beckles’ no case submission.The State is being repre­sented by attorneys Anju Bhola and Melissa Prime. The prosecution is awaiting the transcripts from the court to determine whether the pocket diary inadver­tently was not admitted into evidence by a previous State counsel.Beckles however countered that the transcripts will not be able to help, as he argued that the ingredients ne­cessary to constitute the offence against his clients were lacking.He added that reopening the case will not be enough to fill the gaps.“This matter is approaching 14 years and they asking the court to leap their way to per­fection,” he said.He called for the matters to be dismissed.Beckles, who had asked about the diary in the past, said it was incumbent on the prose­cution to give full disclosure in the matter. “If they fail in their duty, that is a matter for them, that is not a matter for me, respectfully,” the defence attorney said.Prime, who held on in Bhola’s absence and earlier explained about the transcripts, said she was in the court’s hands. The magistrate noted this and said she will rule on the no case submission on June 15.It was back in 2013 that 75 women from Venezuela and the Dominican Republic faced the court charged with soliciting passers-by for the purpose of prostitution at Classic Seamen Hotel and Bar, Vistabella.Lewis was charged with keeping a brothel and failing to make entries into the hotel guest register. Eversley was charged with assisting in the management of a brothel. Lewis brought countercharges of larceny and malicious damage against Guevarro.
