Finance Minister Enoch Godongwana’s legal powers to adjust the fuel levy will come under scrutiny in the Western Cape High Court on Wednesday following a challenge by the EFF.
The Western Cape High Court is expected to hear an application on Wednesday by the Economic Freedom Fighters (EFF) challenging Finance Minister Enoch Godongwana’s authority to set and amend the fuel levy.
The EFF argues that only Parliament has the constitutional power to impose or amend taxes.
The party is challenging the minister’s authority to determine and adjust the fuel levy.
The matter comes after the EFF suffered a legal setback last year in June at the Western Cape High Court when it unsuccessfully tried to block fuel levy increases earlier this year.
