DUMAGUETE CITY, NEGROS ORIENTAL, Philippines — A court in Cebu City has dismissed terrorism financing charges against Dumaguete-based environmental and women’s rights advocate Nancy Estolloso and several other activists in Central Visayas, ruling that the prosecution failed to comply with legal requirements and that the alleged acts did not constitute a crime at the time they were committed.
In a decision penned by Judge Van Russel Inopiquez of the Regional Trial Court Branch 74 in Cebu on May 15 and released on Monday, the court granted the second motion to dismiss filed by Estolloso.
The court ruled that the prosecution failed to comply with the statutory requirement on the publication of the names of persons and organizations designated as terrorist groups. It also held that the acts sought to be penalized did not constitute a crime under the law at the time they were allegedly committed.
