President Donald Trump has repeatedly expressed interest in running for a third term, even while acknowledging there could be legal barriers. Now, two Supreme Court justices say a Trump 2028 presidential run is probably prohibited by the Constitution.
Justices Amy Coney Barrett and Sonia Sotomayor were responding to questions at separate events this week about the Constitution's 22nd Amendment.
The amendment states that no one "shall be elected to the office of the President more than twice." While that language has appeared to indicate Trump couldn't head the White House a third time, it would ultimately be up to the Supreme Court to decide.
Asked whether the amendment is "cut and dry" when it comes to limiting a candidate to two presidential runs, Trump-appointee Barrett told Fox News' Bret Baier Sept. 8, "That's what the amendment says."
Obama-appointee Sotomayor said the public can't know the answer for certain until someone challenges the limit on presidential terms, but acknowledged the Constitution imposes a limit.
