Pretoria supplier fined R75,000 and ordered to refund customer over Ford Focus.
A Pretoria-based motor parts supplier has been ordered to return a customer's vehicle, refund a deposit with interest and pay a R75,000 administrative fine after it was found that it supplied the wrong engine, unlawfully withheld the vehicle for years and violated several provisions of the Consumer Protection Act (CPA).
The National Consumer Tribunal (NCT) ruled that Spares for Africa CC had engaged in prohibited conduct after accepting payment to supply and install an engine for a 2017 Ford Focus but instead installing a different engine and refusing to release the vehicle unless the customer paid additional charges.
The matter originated from a complaint lodged by Happy Nkuna with the National Consumer Commission (NCC).
According to the ruling, Nkuna contacted Spares for Africa in September 2019 seeking to purchase and install an engine for his 2017 Ford Focus.
