According to the judgment, mechanical problems emerged almost immediately. Within weeks, the car developed persistent overheating issues and was repeatedly returned to the dealership for repairs.
A Cape Town motorist has won a significant legal battle as the Western Cape High Court ordered a motor dealership to refund the full purchase price of more than R212,000 for a faulty BMW plagued by serious defects, despite repeated repair attempts that included replacing its engine.
Acting Judge M Louw ordered Autoworld to accept the return of RL's 2012 BMW 320i M Sport automatic and refund him over R212,000.
The dealership was also ordered to reimburse him a further R4,526 owed under an earlier settlement agreement, as well as pay the costs of returning the vehicle.
The case stems from RL buying a second-hand BMW from Autoworld in Goodwood in December 2022.
