Samoa's Foreign Investment Amendment Bill 2026 passed its second reading in Parliament on Thursday, presented by the Minister of Commerce, Industry and Labour (MCIL) Fata Ryan Schuster, the new law proposes changes to Samoa’s foreign investment priorities.

According to the Bill, it would introduce revised definitions of “foreign investor” and “foreign investment” and set disclosure requirements for the beneficial owners of companies, trusts and other legal arrangements investing in Samoa.

Foreign investors would be required to obtain a registration certificate before making an investment. Applications would need to include financial statements, investment proposals, proof of citizenship and other information required by the Ministry of Commerce, Industry and Labour.

Investments made or held through trusts would be subject to additional disclosure requirements.

These include information about trustees, beneficiaries, settlors and people who exercise control over the trust.
