The Telangana High Court on Wednesday stayed the operation of Kalyana Lakshmi and Shadi Mubarak schemes of the State government till September 9. Justice N.V. Shravan Kumar of the HC, passing the order in a writ petition filed by advocate Vijay Gopal contending that the two schemes being operated through eight GOs issued by the State government had no legislative or statutory sanction, said the disbursement of money under the schemes to beneficiaries should also be stopped till that date. The petitioner challenged the basis on which the eligibility criteria like the income limit was fixed by the government for enforcement of the two schemes. The expenditure incurred under the schemes involved substantial amounts from the Consolidated Funds of the State which was contrary to the Articles 202 (3), 204 (3), 266 (3) and 283 (2) of the Constitution of India, the petitioner and advocate Raj Gopal contended. Presenting his contentions, the advocate argued that power to uplift any section of the society must be within the dimension of the legislative power. As per Article 202, the government had to explain how the public funds were being utilised. He claimed that he had locus standi in the matter under Article 13 (2) to question enforcement of such schemes. The advocate maintained that the State government had not referred to any legislative provisions based on which the two schemes were launched in 2014 and being continued till date. During the previous hearing on August 8, the bench granted time to the government to file counter affidavit answering the issues raised by the petitioner.
