The Telangana Real Estate Regulatory Authority (TG RERA) has imposed penalties totalling ₹67.62 lakh on four real estate projects for violations of provisions of the Real Estate (Regulation and Development) Act, 2016. The penalties, imposed through orders issued on August 6, involve projects promoted by AV Infracon Private Limited, SVM Aditya Homes and Adhuri Infra Private Limited. The highest penalty of ₹43.16 lakh was imposed on SVM Aditya Homes in connection with its ‘Tech Homes’ project. TG RERA had earlier found that the developer advertised, marketed and booked units and collected sale consideration without obtaining mandatory registration for the project. The Authority also noted that the project had not obtained approval from the Hyderabad Metropolitan Development Authority (HMDA).A penalty of ₹14.84 lakh and ₹2.83 lakh was imposed on AV Infracon Private Limited for its ‘AV’s West Heights’ and ‘AV’s East Residency’ projects. The Authority found that the promoter had accepted advance amounts, entered into an agreement of sale, marketed and booked a unit and collected the entire sale consideration without obtaining mandatory RERA registration. In both the cases, TG RERA noted that the respondent did not appear before it or file a response despite being served notice and a show-cause notice.TG RERA also imposed a penalty of ₹6.77 lakh on Adhuri Infra Private Limited for collecting 25% of the total sale consideration, amounting to ₹11.12 lakh, from a buyer without executing and registering an agreement for sale. “Receiving 25% of the sale consideration without a written and registered agreement for sale is not merely a procedural lapse but a direct violation of a statutory obligation intended to protect allottees,” the body said.The promoters have been given 30 days from receipt of the orders to remit the penalties to the TG RERA Fund.
