There has been a lack of equal representation in the appointment of judges. Certain communities have had no representation at all. Transparency that is being advocated in appointments is not being followed in the appointment of judges to the Supreme Court and High Courts, said advocate S. Vanchinathan.Addressing journalists at a press meet in Madurai on Sunday, Mr. Vanchinathan stressed the need for inclusivity. He referred to the recent appointment of judges and said most of the names that were cleared were those that were backed by BJP, RSS and the counsels who represented the Central government, Ministries and Departments.There are no Muslim and Christian representations. Also there are no representations from the marginalised communities. There is no adequate women representation. How is it social justice ?, he asked, adding that the discrimination amounted to violation of Article 14 and Article 15 of the Constitution.He pointed out that the law commission in its report said all communities should be given representation. However, this has not been implemented by the Central government. In the Parliament, the Central government said it was committed to enhancing social diversity in judicial appointments. They had given the assurance, but have failed to implement it, he said.He asked why the political parties and senior advocates have not raised concern over the issue of inadequate representation in the appointments. The Collegium system itself has failed and it has turned into a biased system. The Supreme Court has been emphasising the importance of transparency. But where is the transparency in appointment of judges ? Where is the diversity in judiciary ?, he asked.He also asked why the newly appointed High Court judges were sworn in on a Sunday and that too in the afternoon. Were there checking auspicious time. He said the political parties have been discussing issues such as delimitation and NEET. They should also discuss judicial appointments and ensure social justice. This was also an important issue, he said.Mr. Vanchinathan asked why reservation was not being followed in the appointments and said an independent body should be constituted for the appointment of judges.
