The Pretoria High Court has set aside the South African National Roads Agency (SANRAL ) R9.5 billion Routine Road Maintenance tender after declaring the award unconstitutional and unlawful.

This comes after two construction companies, BCB Solutions and Botle Ba Afrika Roads, approached the court to challenge SANRAL’s decision to reject their bids and appoint a panel of 20 companies to carry out routine maintenance work on South Africa’s national roads.

The court found that the procurement process could not stand, and the tender award was reviewed and set aside.

The road agency confirmed that the court order had set aside the tender award and said it would meet with all bidders next week to discuss the implications of the ruling and map out the way forward.
