July 27, 2026 — 5:45pmA woman accused of murdering her baby is applying for a judge-alone trial next year, the court hearing that “a series of ChatGPT” logs will form a substantial part of the evidence.Alanah Gail Smithwick, 29, was arrested last October after her eight-month-old baby Eden Everley-Jane was found dead at a home on Winpara Way, in Baldivis.Alanah Gail Smithwick was arrested in October last year after the death of her eight-month-old daughter.Earlier this month, Smithwick pleaded not guilty to a charge of murder by reason of insanity after a psychiatrist deemed her acutely unwell based on a preliminary report.The accused appeared in the Supreme Court of WA for the first time on Monday where her legal team foreshadowed an application for a judge-alone trial.They also told the court “a series of ChatGPT logs that are voluminous in nature” would make up a substantial part of the evidence in the trial which is expected to commence next year.Smithwick appeared in court via video link from Bandyup Women’s Prison on Monday dressed in prison uniform. She spoke only to acknowledge her name.After the incident on October 30, she was taken to Rockingham Hospital for treatment from the scene, and was then transferred to Fiona Stanley Hospital in a stable condition.Neighbours told 9 News Perth they heard screaming moments before paramedics arrived.Smithwick will be back in the Supreme Court on August 17 where a finalised psychiatric report will be filed for both parties.From our partners
