Gauteng High Court rules against Johannesburg man in eviction case

A Johannesburg man has failed in an urgent bid to halt his eviction from a property owned by his sister after the Gauteng High Court in Johannesburg ruled that he had no reasonable prospects of successfully overturning an eviction order to which he had previously agreed.

Judge Stuart Wilson dismissed an urgent application by the brother to remain in the property pending a review of an eviction order granted by the Randburg Magistrates' Court.

Although the court refused to set aside the eviction order, it extended the deadline for the man and his two sons to vacate the property until the end of August 2026, giving them additional time to secure alternative accommodation.

The dispute centres on a residential property owned by the sister. According to the judgment, the man and his two sons lived at the property without paying rent, while the sister rented out another unit in a neighbouring complex as short-term accommodation. The arrangement allowed the family to occupy the property in exchange for maintaining the adjacent rental unit.
