Sisters evict half-brother after running business in Cape Town property.
A full bench of the Western Cape High in Cape Town has dismissed an appeal by AL and other occupants seeking to prevent their eviction from a commercial property in Gatesville.
The judgment delivered by Judge Dumisani Lekhuleni, with Judges Noluthando Nziweni and Pinda Njokweni concurring, brings to a close a protracted family dispute concerning the ownership and administration of a deceased estate.
The legal battle centres on a property situated on Klipfontein Road, Gatesville, which was owned by the late AML. Following her death in 2005, her daughters, NL and RL, were appointed executrixes of her estate in November 2021.
During her lifetime, AML allowed her stepdaughter, A, to operate a general dealership business from the premises. The business operated since 1980 until A's death in May 2018.
