The appellate court, in a unanimous judgment delivered on Wednesday by Justice Boloukuromo Moses Ugo, dismissed Atewe's appeal against the ruling of the Federal High Court in Lagos, which had granted the Economic and Financial Crimes Commission’s (EFCC) application for the final forfeiture of the assets.
The Lagos Division of the Court of Appeal has upheld the final forfeiture of over N293.97 million, multiple landed properties and investment assets linked to retired Major General Emmanuel Jebe Atewe, affirming that the assets be permanently forfeited to the Federal Government.

The forfeited assets include N293,970,000 in cash, 30,000 MTN-linked investment units held with Stanbic IBTC Asset Management Limited, several plots of land in Abuja located at the Outer Northern Expressway, Jahi, Sabon Lugbe, Kuje, Gaube Farmland Extension II Layout, Sector Centre B Layout, Kuje, as well as a commercial property in Yenagoa, Bayelsa State.
