Mashudu and Pretty Mshandukani have been ordered by the Special Tribunal, alongside associated entities and individuals, to repay R4 million in National Lotteries Commission grant funding after the grant was declared unlawful and set aside following an SIU investigation.
The Special Investigating Unit (SIU) has secured a major victory in its crackdown on corruption at the National Lotteries Commission (NLC), after the Special Tribunal declared a R4 million grant awarded to the Mshandukani Foundation unlawful and ordered that the money be repaid with interest.
In a judgment welcomed by the SIU on Tuesday, the Special Tribunal reviewed and set aside the NLC’s decision to award the grant to the foundation, declaring both the funding approval and the grant agreement invalid.
The Tribunal further ordered that the Mshandukani Foundation, its chairperson Pretty Shandukani, Takalani Israel Mulandana, Thambatshira Maria Khameli and Preldon Construction repay the R4 million jointly and severally. The amount will accrue interest at 10.75% per annum until it is fully repaid.
The ruling follows an SIU investigation that uncovered what it described as serious irregularities in the awarding and use of the grant.
