In a Notice of Appeal obtained by SaharaReporters, on Monday, Ugbebor challenged the June 15, 2026 judgement of the Lagos State High Court sitting at Osborne, Ikoyi, presided over by Justice Akingbola George.
A Nigerian-American engineer, Anthony Ehiedu Ugbebor, has approached the Court of Appeal in Lagos to overturn a High Court judgement which ordered a property developer to refund the N152million he paid for two luxury apartments in Victoria Island instead of compelling the developer to hand over the properties.
In a Notice of Appeal obtained by SaharaReporters, on Monday, Ugbebor challenged the June 15, 2026 judgement of the Lagos State High Court sitting at Osborne, Ikoyi, presided over by Justice Akingbola George.
He argued that the trial court wrongly held that the original property purchase agreement had been extinguished under the doctrine of novation
The appellant maintained that the judge misapplied settled principles of contract law, ignored critical evidence presented during the trial and wrongly dismissed his counterclaim seeking specific performance of the agreement even after finding breaches on the part of the Claimants.
