Belagavi-based Anthropic Softwares Private Limited has sent a letter to the U.S. Securities and Exchange Commission (SEC) with a request that Anthropic PBC, the U.S.-based AI company, disclose in its Initial Public Offer (IPO) documents and its pending dispute over trademark violation.The letter demands that the U.S. SEC should mandate Anthropic PBC to ensure that investors in the U.S. or elsewhere should know the associated risk with Anthropic IPO that includes a possible injunction for core business due to the claim of the Belagavi-based IT company, a possibility of cancellation of trademark in India that can impact its functioning, misrouting of traffic to anthropic.in, a risk that can be persistent despite the outcome of the case.This is a serious brand concern and can have a direct impact on its business as the Belagavi-based company has plans to grow beyond the nation’s borders.The Indian start-up has urged the SEC to ensure that the legal proceedings and related risks are fully disclosed in Anthropic PBC’s IPO documents. It has submitted details of the dispute, arguing that the litigation can have implications for the company’s branding and business operations.Founder of Anthropic Softwares Private Limited Mohammad Ayaz Mulla says that his company was incorporated in April 2017, much before the U.S. entity did.“That is why, we have the right to claim prior use of the ‘Anthropic’ brand. We work in the fields of WiFi monetisation and digitising school administration and a Edutech content creation sector. Our products include AI Agentic OS, Anthropic DopaNet-WiFi Monetisation Platform, TrueGuide Education ERP, Anthropic Socratix Smart University Solutions. We have worked hard to build this company and it is natural that we want to protect it,” Mr. Mulla said.“A commercial suit is pending before the Principal District and Commercial Court in Belagavi where Anthropic PBC’s Indian arm, based in Bengaluru, has filed its objections. The next hearing is scheduled for July 9. Notices have also been issued to Anthropic PBC in the U.S. Their response is expected soon. We have also requested the Registrar of Trademarks to cancel the trademark granted to Anthropic PBC. Anthropic PBC has opposed the trademark application filed by the Indian start-up,” he said.“We are not making any false claims. We are producing before the court documents like patent certificates, recognition by the State and Union government agencies and deployment records. If the U.S. company goes ahead with its IPO without addressing our concern, we will suffer injustice. In fact, the investor who spends money to buy the shares of Anthropic PBC may also face challenges due to the conflicts over brand positioning, operational continuity, goodwill and investor confidence. We demand justice,” Mr. Mulla said.“We keep getting inquiries and other requests from clients that are meant for the U.S. company. I am sure that they may be getting emails meant for us too. We have implemented an automated mechanism to redirect such emails to their intended recipients in compliance with the Digital Personal Data Protection Act, 2023.
