On Wednesday, the United Nations Command expressed the opinion that actions by North Korea within the Demilitarized Zone, including the installation of barbed wire, do “not constitute violations” of the Armistice Agreement. The US-led UN Command went as far as to release a fact sheet pushing back against claims made by the Korean Ministry of National Defense, reviving tensions in the Korea-US dispute over jurisdiction in the DMZ.Neither side benefits from this recurring and completely unnecessary emotional squabbling between allies over what is largely the same issue. Candid discussions will be required to find a solution.The fact sheet released by the UN Command notes that the construction of tactical roads and maintenance work on barbed wire fencing “remains north of the [Military Demarcation Line]” and that “no heavy weapons have been brought into the DMZ,” concluding that such actions do not constitute a violation of the 1953 Armistice Agreement. The UN Command was also quick to point out that South Korea currently operates over 36 road, fence and vegetation clearing projects in the southern DMZ. The Defense Ministry’s declaration on Monday that North Korean actions are a “clear violation” of the agreement was met with swift pushback from the UN Command, and the latest statement drives a further wedge between the two sides.After officially declaring inter-Korean relations to be those between “two states hostile to each other” in 2023, North Korea has been engaged in the construction of tactical roads, the installation of barbed wire fencing and the laying of mines since April 2024 based on a purported need to fortify the southern border. President Lee Jae Myung has publicly commented on the danger of such actions, while Seoul’s Defense Ministry expressed concern over the potential for this to lead to military clashes in November last year and called for talks between military authorities on each side. However, prompted by recent reports in conservative media that North Korea has installed barbed wire fencing in areas within 100 meters of the Military Demarcation Line on the northern side, the ministry may have determined that the issue cannot be allowed to go any further and decided to issue a stern message.The Korean government and the US, which controls the UN Command, have previously engaged in a number of conflicts over DMZ jurisdiction. Notably, the UN Command earned the ire of the Korean government by intervening in the humanitarian transfer of Tamiflu (a cold medicine) between the two Koreas in 2018 when the US and North Korea were engaged in ongoing dialogue. The UN Command, in turn, openly expressed its displeasure over moves within Korea to enact legislation for the peaceful use of the DMZ championed by the Ministry of Unification at the end of last year. The proposed law would allow the Korean government to exercise the right to grant entry to the DMZ for non-military and peaceful purposes. However, we now live in an era in which Korea itself, not the US, must bear primary responsibility for its own defense. It is time for the US to move beyond the rigid view that the UN Command holds sole jurisdiction over the DMZ, and to engage more constructively with the perspectives of its allies.Please direct questions or comments to [english@hani.co.kr]
