The Gauteng High Court, Johannesburg, has dismissed the Sedibeng District Municipality's application for leave to appeal Judge Stuart Wilson's ruling reinstating its suspended municipal manager, Motsumi Mathe.

The troubled Sedibeng District Municipality has lost its bid to appeal the Gauteng High Court, Johannesburg, judgment reinstating its municipal manager, Motsumi Mathe, following his precautionary suspension last month.

On Monday, Judge Stuart Wilson dismissed the municipality’s application for leave to appeal his judgment handed down earlier this month.

Judge Wilson ruled two weeks ago that Mathe must be reinstated after he was placed on precautionary suspension in May for allegedly failing to timeously discipline Chief Financial Officer, Mathapelo Masisi.

The judge declared that the May 12 council resolution placing Mathe on precautionary suspension was constitutionally invalid and set it aside.
