Reacting to the judgment, Ali-Keffi insisted that the court did not dismiss the case on its merits.
Retired Major General Danjuma Hamisu Ali-Keffi has vowed to continue his legal battle against the Nigerian government and military authorities following the dismissal of his N200 billion suit challenging his compulsory retirement from the Nigerian Army and alleging violations of his fundamental human rights.
Ali-Keffi, who described the ruling of the National Industrial Court in Abuja as a victory for "technicalities" over substantive justice, said he was considering several legal options, including an appeal and possible action before international courts.
The National Industrial Court had on Friday dismissed his suit after upholding a preliminary objection by the Nigerian Army, ruling that the matter was statute-barred because it was filed outside the three-month period prescribed by law. The court also declined jurisdiction over his human rights claims, directing that such issues be pursued before a federal or state high court.
