The Land and Titles Appeals Court will deliver a ruling on 26 June on a leave to appeal application challenging the LTC decision ordering 18 Leauvaa families who are residing on Afega land beyond the 723 acres to leave.

Justice Alalatoa Rosella Papalii presided over the matter after being sworn in as Acting Supreme Court Judge, a day earlier.

The Leauvaa families were represented by Sala Josephing Stowers and Tuala Tele’a. The families want to appeal a decision that stated that Afega were the rightful owner of the disputed land and had the legal authority to evict the families.

However, a stay on the eviction was granted pending the appeal.

Sala said in 2017, the Court of Appeal ruled that the 18 families residing beyond the 723 acres will not leave; however, in 2018, the decision was overturned. She said a Court of Appeal ruling cannot be overturned by any other court.
