Tribunal allows motorist's case against We Buy Cars to proceed over defective VW Kombi.
A Gauteng consumer has won the right to pursue his complaint directly before the National Consumer Tribunal after alleging that a vehicle purchased from We Buy Cars was defective, misrepresented and sold at a higher price than advertised.
The tribunal granted Matome Victor Maponya leave to refer his complaint directly to the Tribunal following a notice of non-referral issued by the National Consumer Commission.
The dispute stems from Maponya's purchase of a used Volkswagen Kombi T5 2.0 TDI from We Buy Cars' Germiston branch in December 2022. According to court documents, the vehicle was advertised online at a floor price of R223,900. After viewing and test-driving the vehicle, Maponya secured financing and proceeded with the purchase.
Maponya alleges that several defects were apparent when he inspected the vehicle. These included a cracked tailgate, a cracked windscreen, damaged roof lining, a defective driver's seat and the absence of a vehicle jack. He claims that We Buy Cars agreed to address some of these issues before delivery, including repairing the tailgate, supplying a jack, servicing the vehicle and performing a full valet.
