A couple whose neighbour’s house encroaches onto their property went to court seeking $228,200.

Instead they were awarded $14,000, a public judgment shows.

Adam Collins and Jodi Turton bought their 228m² Wellington property in 2013.

Their neighbour, Shashil Winspear, bought his 384m² property in 2020.

The couple brought a claim against Winspear under the Property Law Act 2007 (PLA) on the basis that part of Winspear’s house is on their property and was therefore “a wrongly placed structure”.
