A worker has failed in his bid to have an alleged workplace assault substantively investigated after an employment tribunal ruled it had no legal standing to hear the case.

The dispute arose from an incident when a warehouse employee claimed he was assaulted by a colleague. According to workplace records provided by Service Foods Limited, Peter Saunders first raised the accusation during an unrelated disciplinary meeting in February 2023.

The company’s people and culture business partner requested a written statement of the alleged assault and specific details of when the incident occurred so that CCTV footage could be reviewed. Service Foods again requested this information in March 2023 and offered to assist Saunders in preparing a written statement, but he declined the assistance.

The Employment Relations Authority had already found in a preliminary determination on March 31, 2025, that Saunders had not raised any personal grievances within the statutory 90-day timeframe. Saunders did not challenge that finding.
