Police say the three people arrested during Wednesday’s protest by supporters of Kaia Sealy in Port of Spain were charged under the Emergency Powers Regulations and the Summary Offences Act.Protest organiser Alyssa Phillip, her mother Camille Caresquero, and social media personality Jason De Silva were released after 8 p.m. on Thursday after spending just over 24 hours in custody.Police sources said yesterday they were each placed on a bond of $40,000, signed by a Justice of the Peace, and are expected to appear before a Port of Spain court on Monday.Superintendent Edgar Baird of the Port of Spain Division laid charges against Phillip and Caresquero under Regulation 11(a) of the Emergency Powers Regulations.Under the regulation, it is an offence for anyone to attempt, either orally or through other means, to sway public opinion in a way that could threaten public safety.De Silva was separately charged by ACP Garvin Henry for disorderly behaviour, contrary to Section 52(2) of the Summary Offences Act.Breaches of the Emergency Powers Regulations carry significant penalties, including fines of up to $100,000 and imprisonment for up to five years.The current legal framework is established under the Emergency Powers Regulations, 2026 (Legal Notice No 40 of 2026), enacted pursuant to the declaration of the ongoing state of emergency.Under the Summary Offences Act, any person in a public place who is guilty of riotous, indecent, or disorderly behaviour, or who insults, obstructs or annoys persons in a public place, police station, government office or place of public entertainment is liable to a fine of $200 or imprisonment for two months.The Express spoke briefly with Phillip on Thursday night, who confirmed the three were free and that they were all heading home.“We have been released, but I will not make any official statement until I rest and recuperate,” Phillip said.Yesterday morning Phillip posted on her social media pages, thanking her supporters, and indicating she would be at a planned protest in the afternoon at the Forensic Science Centre, Federation Park.On Thursday, police urged protesters to conduct themselves lawfully, and avoid confrontations with officers and other members of the public.
