Former Delhi chief minister Arvind Kejriwal, former deputy chief minister Manish Sisodia, and AAP leader Durgesh Pathak have decided to participate in the proceedings in the Delhi excise policy case, which is now being heard by Justice Manoj Jain of the Delhi high court after Justice Swarana Kanta Sharma recused herself from hearing the case. The case concerns the CBI’s revision petition challenging a trial court order issued on February 27 that discharged Kejriwal. (Vipin Kumar/HT)Taking note of the latest development, the matter has now been listed for hearing on July 16.Justice Manoj Jain observed that three “vakalatnamas” appeared to have been filed on behalf of the three AAP leaders who were earlier unrepresented and had boycotted the proceedings before Justice Swarana Kanta Sharma. A vakalatnama is a document authorising a lawyer to represent a party before a court. The court postponed further proceedings as lawyers were abstaining from work in the high court on the day, and also to allow counsel to appear."If they have filed vakalatnama, on the next date we can see which date can be given and a schedule can be drawn... It seems some vakalatnama has been filed," the judge observed. The case concerns the CBI’s revision petition challenging a trial court order issued on February 27 that discharged Kejriwal and other accused in the Delhi excise policy case.On February 27, the trial court discharged Kejriwal, Sisodia, and 21 others in the liquor policy case, saying the case could not withstand judicial scrutiny and had lost credibility in its entirety. The CBI later approached the high court. On March 9, Justice Sharma's bench stayed the trial court's recommendation seeking departmental action against the investigating officer in the liquor policy case. While issuing notices to all 23 accused on the CBI’s plea challenging their discharge, Justice Sharma observed that certain findings and remarks made by the trial court at the stage of framing charges appeared, at first glance, to be incorrect and required further examination. This is a developing story. More details awaited.
