The High Court has paved the way for persons who wish to change their gender markers to do so without the hindrances of being either male, female, or intersex.

Justice Bahati Mwamuye, in his judgment, in a case filed by transgender person Audrey Mbugua, Maureen Muiya, and Arnest Thaiya, said that the delays and silence cannot be used to defeat Constitutional requirements.

He observed that despite several orders requiring the government to amend Mbugua’s birth and identification documents, the deaths and births registry failed to honour them, citing a lacuna in law.
